JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 10-09-2015 The petitioner is aggrieved by the order dated 28.10.2011 (Annexure-8) passed by the respondent Additional Collector, Samastipur, whereby Mutation Revision No. 92 of 2009-10 (wrongly mentioned as Mutation Revision No. 42 of 2009-10 in paragraph-1 of the writ petition), filed on behalf of the respondent no.6 to 10 has been allowed and the order passed by the respondent D.C.L.R., Rosra has been set aside. In the considered opinion of this Court, the petitioner has an alternative and efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of The Bihar Land Tribunal Act, 2009.

Patna High Court CWJC No.723 of 2012 (5) dt.10-09-2015 2/2 In above view of the matter, writ petition is dismissed with a liberty to the petitioner to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief(s) with respect to the land in question.
