The present petition is for regular bail in Shastri Nagar P.S. Case No. 57 of 2021 registered for the offences punishable under Sections 363, 365 and 34 of the I.P.C. Petitioner had filed Bail Petition No. 1617 of 2021 on 16.09.2021, the case is pending in the Court of learned Sub-Judge IVth Patna. Learned counsel for the petitioner cited bail granted to co-accused Navneet Kumar S/o Namendra Mishra Vs. State of Bihar vide Annexure-2 in Criminal Miscellaneous No. 50743 of 2021 dated 30.03.2022. Accordingly, the petitioner is entitled to regular bail on par with Navneet Kumar.

In the light of these facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the

Patna High Court CR. MISC. No.50699 of 2022(2) dt.16-12-2022 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Shastri Nagar Police Station Case No. 57 of 2021, with the following conditions.

1. The petitioner shall co-operate in investigation and in conclusion of the trial.

2. He shall remain present on each and every date of trial till conclusion of trial.

3. He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial.

4. In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.

5. The Court below shall verify the criminal antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate step for cancelling bail bond of the petitioner. However, acceptance of bail bonds, in terms of the aforementioned order shall not be delayed for this purpose or in the name of verification.
