The petitioner is in custody since 24.06.2017 in connection with Ishakchak P.S. Case No.45 of 2017, registered under Sections 384, 120B of the Indian Penal Code.
The learned counsel for the petitioner submits that the alleged demand for Rangdari from the informant was made from a mobile No. bearing No.8294134712. It is further submitted that the alleged mobile no. does not belong to the petitioner but only on the basis of confessional statement made before the police by co-accused, Md. Azad, the petitioner has been implicated in connection with the present case and is languishing in jail. It is further submitted that the confessional statement made before the
Patna High Court Cr.Misc. No.33192 of 2018 (3) dt.05-07-2018 2/2 police by co-accused has no evidentiary value. In view of the aforementioned facts and circumstances and the period of custody, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Bhagalpur, in connection with Ishakchak P.S.
