JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mohaniya Mahila P.S. Case No. 59 of 2018 registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. As per FIR there is allegation against the petitioner of demand and subjecting the informant to cruelty. Submission of learned counsel for the petitioner is that as a matter of fact she is suffering from mental disease and for that petitioner has taken steps for her treatment but the informant and her family members are not ready for that, as such the present case has been filed. However, petitioner is ready to keep her with dignity and care and is also ready to get her treated by competent Doctor. Heard learned APP and learned counsel for the informant, who has no objection to the above proposal unless she was not subjected to further cruelty.

No.49125 of 2019(4) dt.22-10-2019 2/2 In view of above facts and circumstances, this application is disposed of with direction to the petitioner to appear in the court below on 14.11.2019, on that day the informant shall also remain present in court and on filing an affidavit by the petitioner that he is ready to keep her with dignity and care and also ready to take her from the court itself, the provisional bail granted to the petitioner by order dated 6.8.2019 shall be extended by the court below to a period of six months and during that period both the parties shall appear in the court, so that the court may watch their conduct and marital relationship and once the court is satisfied with the same, the court below shall confirm the bail bonds of the petitioner, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner.
