JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 25-01-2017 Heard learned counsel appearing for the parties. Learned counsel for the petitioner submits that the petitioner has taken loan of Rs.5,00,000/- for the purposes of construction of his house from the Union Bank of India, Gaya Main Branch, Dhami Tola, Gaya. Altogether, the petitioner has returned Rs.2,87,500/- and there is outstanding dues of Rs.9,01,653.80/- upto 31st January, 2017.
Learned counsel for the petitioner further submits that the petitioner is ready to return the outstanding amount in equal installments of Rs.25,000/- per month.
Patna High Court CWJC No.3406 of 2015 dt.25-01-2017 2/2 Learned counsel for the Bank has not disputed the offer of the petitioner.
In such view of the matter, let the petitioner liquidate the aforesaid outstanding amount in equal installments of Rs.25,000/- per month along with interest which would added in the principal amount.
It is clarified that if the petitioner would fail to deposit three successive installments, the Bank will be at liberty to take legal action against the petitioner in accordance with law. With the aforesaid observations and directions, this writ application is disposed of.
