The petitioners apprehend their arrest in connection with Gogri P.S. Case No.94 of 2017 registered under Sections 341, 323, 308, 504 and 379/34 of the Indian Penal Code. The allegation of the informant Risha Devi is that in the evening of 27.02.2017, quarrel started in between her daughter Gunjan Kumari and Mamta Devi, the daughter of her elder brother-in-law Patori Yadav (petitioner no.1). When the informant reached to pacify the dispute, Patori Yadav (petitioner no.1), his wife Shila Devi (petitioner no.2) and daughter Mamta Devi (petitioner no.3) started to abuse and caused blood oozing
Patna High Court Cr.Misc. No.31211 of 2018(2) dt.12-06-2018 2/2 injury on the head of the informant through lathi and danda. In that course, Patori Yadav (petitioner no.1) snatched the gold nose pin worth Rs.1500/- of the informant and gold ear ring of her daughter.
Learned counsel for the petitioners submits that the petitioners and the informant are Gotiyas and due to some dispute, there was hot exchange of words in between them in which the informant sustained injury, which is simple in nature. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Ms. Ankita Jaiswal, Judicial Magistrate, First Class, Khagaria, in connection with Gogri P.S. Case No.94 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
