Petitioner, already in custody, seeks bail in connection with Katoriya P.S. Case No.09 of 2018 registered under Sections 302, 201 and 120(B) of the Indian Penal Code. Allegation in brief is that the informant's father did not return back in the night, later on his dead body was found as he was killed and suspicion is raised against the accused persons that they have committed the murder on account of land dispute.
Learned counsel for the petitioner submits that on account of the land dispute, the petitioner has been implicated in this case, except suspicion raised by the informant, there is no other material against the petitioner collected by the
Patna High Court Cr.Misc. No.31815 of 2018(3) dt.29-06-2018 2/2 investigating agency; charge sheet has been submitted in this case and petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Naresh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Banka in connection with Katoriya P.S. Case No.09 of 2018.
