JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Gandhi Maidan P.S. Case No.468 of 2017 registered for the offences punishable under Sections 467, 468, 471, 420, 120(B)/34 of the Indian Penal Code.

Petitioner applied for compassionate appointment and in course of documents verification, it was found that he had submitted forged certificate.

Submission on behalf of the petitioner is that the petitioner had submitted document showing that he got second division by the concerned board and the aforesaid document was submitted on the basis of school leaving certificate issued by the

Patna High Court Cr.Misc. No.31639 of 2018 (3) dt.22-06-2018 2/2 concerned school which is evident from perusal of column 9 of Annexure-2 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learner Additional Chief Judicial Magistrate, VI, Patna, in connection with Gandhi Maidan P.S. Case No. 468 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C.
