The petitioner, in the present case, is seeking regular bail in connection with Kankarbagh P.S. Case No.258 of 2018 registered for offences alleged under Sections 290 of I.P.C. and Sections 4, 5 and 7 of Immoral Traffic Act.
Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he was found sitting in another room of the house where the raid was conducted. Pointing out the seizure list, learned counsel submits that the seizure of incriminating materials/articles have been shown from the possession of the co-accused Vikash Kumar and Rockey Kumar. It is submitted that thrust of the allegations is against the house owner Munna Jee and two ladies Soni Devi and Usha Devi who
Patna High Court Cr.Misc. No.32532 of 2018 (2) dt.12-06-2018 are said to be involved in running the brothel house. It is further submitted that this petitioner has got no criminal history, he has been falsely implicated in this case on mere suspicion and in absence of any articles from his possession he cannot be connected with the present case.
On the other hand, learned A.P.P. for the State has opposed the prayer for bail and submits that this petitioner was one of the persons found present in the house when the raid was conducted by the police party.
Considering the facts and circumstances of the case whereunder the petitioner is said to be sitting in the second room of the house and the seizure list does not show any seizure of incriminating articles from his possession as also that he is in custody since 30.03.2018, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna, in connection with Kankarbagh P.S. Case No. 258 of 2018, subject to the conditions under Section 437(3) Cr.P.C.
