JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The present application has been filed for modification of order dated 23.08.2021 passed in Cr. Misc. No. 572 of 2021 to the extent of extending the period of surrender. On the grounds mentioned in the modification application, the period of surrender is extended by six weeks from the date of receipt/production of a copy of this order in

Patna High Court CR. MISC. No.61213 of 2021(2) dt.04-02-2022 2/2 connection with Bihta P.S. Case No.324 of 2020, pending in the Court learned Special Judge Excise, Patna, subject to deposit of sum of Rs.2000/- (Rupees Two Thousand) in the Victim Compensation Fund.

The order dated 23.08.2021 is modified to the extent as indicated above.

A supplementary affidavit has also been filed by the petitioner submitting that due to inadvertence in the modification application Bihta P.S. Case No.324 of 2021 has been typed in para no.3 and the prayer portion, in place of Bihta P.S. Case No.324 of 2020.

Let it be so corrected and read as Bihta P.S. Case No.324 of 2020.

Accordingly, this modification application stands disposed of.
