JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw anticipatory bail petition with respect to petitioner No. 1, Anil Singh @ Anil Kumar Singh. Permission is granted.

The anticipatory bail petition with respect to petitioner No. 1, Anil Singh @ Anil Kumar Singh, is dismissed as withdrawn.

Heard learned counsels for petitioner No. 2 and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307, 504, 34 and other allied sections of Indian Penal Code.

As per prosecution case, this petitioner along with other accused persons assaulted the informant and his family

Patna High Court CR. MISC. No.50430 of 2022(2) dt.15-12-2022 2/2 members by means of iron rod, rami and snatched golden chains.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that specific allegation of assault is against co-accused Anil Singh and so far this petitioner is concerned there is no accusation of overt act against him. Case and counter case. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner No. 2 in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bhojpur at Ara in Jagdishpur P. S. Case No. 181 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
