The petitioners have filed the present application for initiation of a contempt proceeding against the opposite parties for their wilful disobedience of the interim order dated 23.01.2024, whereby this Court has directed to list this case on 05.03.2024 and it was observed that the concerned respondents shall take all endeavours to ensure payment of all the admissible dues of the father of the petitioners.

3. A show cause affidavit has been filed with a categorical assertion that all the substantive amounts have been paid to the petitioners. So far the payment under the head of Gratuity is concerned, the Treasury Officer, Patna Collectorate has been authorized by the Accountant General, Bihar, Patna to

3/4 ensure payment. It is apprised to this Court that when the petitioners will approach before the authorities concerned along with necessary documents, they shall ensure payment of the same.

4. Learned Advocate for the petitioners, at this juncture, submitted that since the contempt petition has been filed for non compliance of the interim order and yet the writ petition is to be disposed off where a prayer for interest over the delayed payment has been made.

5. Learned Advocate for the State-opposite parties submitted that the grievance of the petitioners has been redressed and all the admissible amounts under different heads have been paid.

6. Considering the aforesaid factual position, this Court deems it proper to close the contempt petition.

7. Accordingly M.J.C. No. 2372 of 2024 stands closed. CWJC No. 18247 of 2023

8. Since the contempt petition has already been closed considering the fact that the grievance of the petitioners has been redressed, the Court deems it fit and proper to dispose off the writ petition also with liberty to the petitioners to approach before the authorities concerned for interest over the delayed

9. Accordingly, C.W.J.C. No. 18247 of 2023 stands disposed of with the liberty aforesaid.
