1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 353, 120B and 34 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent.

4. The informant alleges that on information that petitioner along with Anil were planning to commit an occurrence, he along with the police force reached the place of occurrence from where eight accused persons were apprehended with arms and ammunition and one accused fled.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the name of the petitioner transpired based on information received by the police that he along with Anil were planning to commit an occurrence based on which the police reached the place of occurrence from where eight accused persons were apprehended. It is next submitted that petitioner is aged about 45 years and has remained a person with clean antecedent and all of a sudden based on suspicion he has been made a criminal, it is also submitted that petitioner is a businessman and is an income tax payee and has a shop in the name and style of "Apna Collection" at Shivdhara Chowk having GSTIN No. 10DDLPM2799R12P. It is further submitted that petitioner, in support of his claim that he is a businessman, has also brought on record the income tax return for the assessment year 2021-2022 and 2022-2023

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court

No.51715 of 2023(2) dt.09-08-2023 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Darbhanga P.S. Case No. 46 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
