The petitioner is apprehending his arrest in connection with Raghopur (Rustampur) P.S. Case No. 97 of 2014 for the offences instituted under Sections 302 and 201/34 of the IPC. The prosecution story, in brief, is that the informant's brother, namely, Kameshwar Singh, had been beaten till his death by his in-laws of Sasural and dead body was thrown at Jethuli Ghat. It is further alleged that the motive behind the occurrence is said to be quarrel between the deceased and his wife because the wife of the deceased went to her Naihar alongwith Rs. 40,000/- from her matrimonial house.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.10501 of 2016 (2) dt.18-04-2016 2/2 petitioner has got no criminal antecedent. He is the cousin brotherin-law of the deceased. There is no external injury on the body of the deceased. There is no eye witness to the alleged occurrence. The other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. No. 37070 of 2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Raghopur (Rustampur) P.S. Case No. 97/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
