14-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application has been filed for the grant of regular bail to the petitioner in connection with Dawath P.S. Case No. 143 of 2017, Session Trial No. 113 of 2018, for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that from bare perusal of the First Information Report it would appear that the allegation of firing on the mother of the informant is against one Giddik. It is alleged that this petitioner was also there, however no specific allegation has been made against him.

Patna High Court Cr.Misc. No.32538 of 2018 (2) dt.14-06-2018 Learned Additional Public Prosecutor for the State is present.

Considering the facts and circumstances of the case wherein it is alleged that the petitioner was standing there but there is no allegation of causing firing by this petitioner, I would direct release of the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Assistant Sessions Judge - II, Rohtas at Sasaram, in connection with Dawath P.S.
