The petitioner seeks bail in connection with Muffasil P.S. Case No. 631 of 2023 instituted for the offence under Sections 307 & 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Earlier vide order dated 10-01-2024, passed in Cr. Misc. No. 83834 of 2023 anticipatory bail of the petitioner was rejected by a Co-ordinate Bench of this Court.

Prosecution case in short is that the accused, including the petitioner, allegedly threatened the informant's family to force a compromise in a previous case and later attacked them with firearms, injuring the informant's nephew.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14-05-2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. As per accusation against the petitioner, it is alleged that petitioner has fired upon the informant, leading to injury on eye brow, but injury is found to be simple in nature that too is prepared from a private hospital. Other co-accused has been granted bail by this Court vide order dated 15-01-2024, passed in Cr. Misc. No. 85468 of 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and nature of injury found to be simple in nature, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties

Case No. 631 of 2023, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
