Petitioner seeks bail in a case registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Wife of the petitioner died within seven years of her marriage in unnatural circumstances in her matrimonial house. Allegation is of demand of motorcycle and on nonfulfillment, threat to be ready to face the consequences. The maternal family members of the victim have supported the allegation of demand of dowry and torture for the same. Learned counsel for the petitioner submits that petitioner is in custody since 27.03.2018. The victim committed suicide after departure of the petitioner to his

Patna High Court Cr.Misc. No.34777 of 2018 (3) dt.29-06-2018 2/2 work place. Petitioner is working in Army.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail connection with Kanti Police Station Case No. 09 of 2017 pending in the court of learned Sub Divisional Judicial Magistrate, West Muzaffarpur/successor court. Hence, prayer for bail is refused.
