====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 06-09-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with S.T. No.277 of 2024 arising out of Siwan Muffasil P.S. Case No.245 of 2023, registered for the offence punishable under Sections 395 of the Indian Penal Code.

3. As per the prosecution case, when the informant opened his jewellery shop, in the meantime four miscreants covering their faces and armed with pistol and katta entered into the shop of informant and looted ornaments of shop thereafter fled away on bike.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner was not named in the

Patna High Court CR. MISC. No.57625 of 2024(3) dt.06-09-2024 2/2 F.I.R. and nothing incriminating has been recovered from the possession of petitioner. Learned counsel submits that neither T.I.P. has been conducted in this case nor any witness has identified the petitioner. He further submits that similarly situated two co-accused persons have been granted bail by the learned Court below. The petitioner has one criminal antecedent, in which he is on bail. Learned counsel submits that charge has already been framed in this case and he is in custody since 16.02.2024. Petitioner undertakes to cooperate in the trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIII, Siwan in connection with S.T. No.277 of 2024 arising out of Siwan Muffasil P.S. Case No.245 of 2023. (Sunil Dutta Mishra, J) Ritik/- U T
