The petitioners apprehend their arrest in Pirpainty P.S.Case No.214 of 2014, registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code. The informant made specific allegation that Nirbhy Roy @ Chamcham Roy and Abhay Roy @ Bettu Roy assaulted with sharp and pointed weapon. Bhunshwar Roy came to save him. Shivjee Roy is alleged to have assaulted the informant. Vidhyavati Rai also assaulted the father of the informant with sickle on his leg.

It is submitted that there is no specific allegation of assault against the petitioners. The injuries are simple in nature. Vidhyawati Devi wife of Shivjee Roy lodged a counter version

Patna High Court Cr.Misc. No.7427 of 2015 (2) dt.23-02-2015 against the informant and others.

Taking into consideration the facts that there is no specific allegation of assault against the petitioners and there is a counter version, petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of SDJM, Bhagalpur in Pirpainty P.S.Case No.214 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
