1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Harsidhi Police Station Case No. 683 of 2024, dated 13.12.2024, disclosing offences under Sections 191(2)/191(3)/190/61(2)/126(2)/127(2)/115(2)/109/121(2 )/132/352/351(2)/263(B) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report, is that on 13.12.2024, during a raid to arrest accused Shatrudhan Sahani of Harsidhi Police Station Case No. 413 of 2024, the police were assaulted by 10 to 15 persons with lathi and danda. Later the accused was freed by them from the custody of police. The name of the

4. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and was not caught from the place of occurrence. The petitioner has falsely been implicated in the present case due to village politics. He next submits that name of the petitioner has transpired on the basis of disclosure by the village Chowkidar. He further submits that the similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 40325 of 2025, dated 04.07.2025.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that name of the petitioner has been disclosed by the Chowkidar and similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/-
