Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Arwal P.S. Case No. 241/2020 registered for the offence punishable under Section 30(a) of the Excise Act. Allegation against the petitioner is of selling foreign liquor.

Learned counsel for the petitioner is submitted that on a secret information the house of the petitioner searched but no incriminating article and foreign liquor was recovered from his

Patna High Court CR. MISC. No.6693 of 2021(2) dt.06-12-2021 2/2 house. Further submits that petitioner has not apprehended on spot. It is also submitted that there is no relevant and cogent evidence against the petitioner.

Learned A.P.P. for the State opposes the prayer of bail. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Jehanabad in connection with Arwal P.S. Case No.241/2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) ravishankar/- U T
