JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Petitioner being elder brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 379, 341, 323, 504, 34 of the Indian Penal Code.

The accusation is of torture for giving inferior quality of articles in dowry. The torture was inflicted for nonfulfilment of further demand of dowry. It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the entire in-laws family including the petitioner. Considering the fact that thrust of accusation is against the husband of the informant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.9490 of 2016 (2) dt.25-02-2016 2/2 each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Mahila P.S. Case No. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
