In this case, the petitioner is apprehending his arrest in connection with Bhagwan Bazar P.S. Case No. 103 of 2015 for offence under Sections 341, 323, 354, 376/511, 380/34 of the Indian Penal Code.

As per allegation, the victim girl is eight years old. From time to time, the petitioner was harassing the girl. On the date of occurrence, the petitioner has crossed the level and abused the girl sexually and so much so that on 14.9.2014, he came along with others and threatened to withdraw the case filed by the Informant.

It appears that the alleged occurrence has taken place

Patna High Court Cr.Misc. No.10039 of 2016 (2) dt.08-03-2016 on 20.1.2014 but, the case has been filed on 17.9.2014. Learned counsel for the petitioner submits that there is no explanation of such a long delay in filing the case.

Looking to the entire facts and circumstances of the case, this Court would direct for release of the petitioner, namely, Awadhesh Kumar Singh @ Awadhesh Singh on bail in the event he would surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 103 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
