The petitioner apprehends his arrest in connection with Khagaul P.S. Case No.67 of 2020 registered for the offences punishable under Sections 304(b) and 34 of the Indian Penal Code.

Though in the preset case, the process under Sections 82 and 83 of the Cr.P.C. against the petitioner has been completed on 27.08.2021, but Mr. Ghanshyam Tiwary, learned counsel for the petitioner has failed to inform this Court about the same.

Lawyers have the duty to point out all the relevant facts before the Court and they should not behave in this manner and suppress the material facts which goes at the maintainability of the anticipatory bail application.

Patna High Court CR. MISC. No.6524 of 2021(3) dt.25-01-2022 2/2 In view of the aforesaid, this application for anticipatory bail is not maintainable and, therefore, is dismissed. The petitioner is imposed a cost of Rs. 10,000/- (Ten Thousand) for suppressing the fact of process under Sections 82 and 83 of the Cr.P.C.

The prayer for regular bail of the petitioner shall be considered by the learned Court below only after the cost of Rs. 10,000/- is deposited by the petitioner in the Victim Compensation Fund.
