The petitioner seeks bail in connection with a case registered for the offence punishable u/s 302, 34 of the IPC. 3.

As per the prosecution case, after death of one Ashok Ram, husband of the informant's daughter, all the accused persons including the petitioner, in furtherance of their common intention are alleged to have committed murder of the daughter of the informant after assaulting her.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to ulterior motive. There is no specific allegation against the petitioner. Charge sheet has been submitted against the

Patna High Court CR. MISC. No.55327 of 2024(2) dt.14-08-2024 2/2 petitioner and there is no allegation against him to tamper the witnesses. He has no role in the present case and only on suspicion, he has been made accused in this case. The petitioner has no criminal antecedent and has been languishing in custody since 24.04.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case and the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Singhiya P.S. Case No.254 of 2023.
