The petitioner, already in custody, seeks bail in connection with Sadar P.S. Case No. 27 of 2018 registered under Sections 393 of the Indian penal Code and Sections 25(1b)a/26/35 of the Arms Act. Allegation in brief is that a country made pistol with empty magazine were recovered from the possession of the petitioner.
Submission is that allegation of seizure is false, however, as per allegation, only a pistol without cartridge was recovered from the possession of the petitioner and is in custody since 04.02.2018 and investigation was earlier completed. Having considered the aforesaid facts and circumstances, the petitioner, namely, Sushil Sahni, is directed to be released
Patna High Court Cr.Misc. No.35550 of 2018(2) dt.21-06-2018 2/2 on bail, after framing of charge, upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga in connection with Sadar P.S. Case No. 27 of 2018.
