====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-06-2022 Heard learned counsel for the petitioners, State and informant.

Petitioners apprehend arrest in a case registered for offence punishable under section 302 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioners submits that during investigation none of the eye witnesses have stated that these petitioners killed the son of the informant and threw the dead body on the road. He submits that in fact gotia of the informant was having evil eye on the property of the informant and they might have killed his son to grab the property and only on suspicion petitioners have been made accused in this case. Learned counsel appearing for the State as well as the

Patna High Court CR. MISC. No.6419 of 2021(4) dt.20-06-2022 2/2 informant oppose the prayer for bail. They submit that witnesses have stated that petitioner no.1 had illicit relation with the wife of deceased and cycle of the deceased has also been recovered from the house of the petitioner.

In view of the nature of allegation, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
