Learned counsel appearing on behalf of the petitioner submits that he has received instruction that the petitioner is willing to file a detail representation before the Additional Chief Secretary, Road Construct Department, Government of Bihar for redressal of his grievance, as prayed for in the present writ petition, including payment of gratuity.

3. Considering the aforesaid submissions made on behalf of the petitioner without going into the merit of the case,

Patna High Court CWJC No.11276 of 2023(2) dt.15-09-2023 2/2 the Additional Chief Secretary, Road Construction Department, Government of Bihar is directed to pass a reasoned order in accordance with law within a period of six weeks from the date of filing of the representation and in case the petitioner is entitled for payment of gratuity, the same may be granted to him after verifying as to whether the petitioner has been acquitted in the criminal case.

4. With the above observation/direction, the present writ petition is disposed of.
