The petitioner is apprehending his arrest in connection with Karakat P.S.Case no.109 of 2017 registered for offences punishable under Sections 147, 148, 149, 341, 342, 323, 504, 506, 326, 307, 452 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with other accused persons created nuisance and made firing and due to that firing some persons received injuries.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed of firing rather 3-4 persons are said to have fired. Further submission is that the main accused Abhay Singh has been granted bail by this Court, vide

Patna High Court Cr.Misc. No.31979 of 2018 (2) dt.28-06-2018 2/2 order dated 4.4.2018 passed in Cr. Misc. No.19460 of 2018. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on the ground that another co-accused has been granted privilege of the anticipatory bail by this Court considering the same he will pass appropriate order, if possible on the same day.
