2. The petitioners apprehend their arrest in a case registered for the offence under Sections 323, 341, 353, 414, 188 of the I.P.C. and Sections 30(a), 37, 45 of Bihar Prohibition and Excise Act.

3. Total 220 bottles of Codeine Syrup of 100 ml. each have been recovered from a hut and different vehicles.

4. It is submitted on behalf of petitioners that no incriminating article has been recovered from the conscious possession of the petitioners and only on suspicion, they have been made accused in this case. Petitioners have got clean antecedent.

5. Considering the nature of allegation and clean

Patna High Court CR. MISC. No.51403 of 2023(2) dt.19-08-2023 2/2 antecedent of petitioners, let the above named petitioners, in the event of their arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge 1st Khagaria in connection with Khagaria P.S. Case No. 69 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
