Mr. Sri Satyavarat Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 27-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Patrakar Nagar P.S.Case No. 573 of 2017 registered under Sections 406, 419, 420, 467, 468 and 471/34 of the Indian penal Code and 66A of the Information and Technology Act.

This is the second bail application filed by the petitioner as earlier one was rejected by order dated 29.03.2018 passed in Cr. Misc. No. 9809 of 2018. Allegation against the petitioner is that he deposited a clone cheque of Rs. 3,80,000/- in his account of another account holder of the bank namely Awalesh Prasad and said money was transferred to his account and subsequently it was detected that it was a clone cheque.

Submission is that petitioner is a student of B.Tech. and

Patna High Court Cr.Misc. No.35919 of 2018(2) dt.27-06-2018 2/2 had deposited Rs. 3,80,000/- to the Canara Bank account wherefrom money was withdrawn. This fact is also admitted by Mr. Prabhat Kumar, learned counsel appearing on behalf of the Bank that said money has been deposited by the petitioner and this petitioner has no other previous antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Rishav Raj, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Patna in connection with Patrakar Nagar P.S. Case No. 573 of 2017.
