JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioners seek bail in anticipation of their arrest in connection with Paroo P.S. Case No. 262 of 2017, dated 07.11.2017, instituted for the offences punishable under Sections 304-B and 201/34 of the Indian Penal Code. It has been alleged in the F.I.R. by the father of the deceased that his daughter was married to the son of

Patna High Court Cr.Misc. No.31652 of 2018 (3) dt.29-06-2018 2/3 petitioner No. 1, who was killed and her dead-body was cremated stealthily for non-fulfillment of the demand of a car. Mr. Ajay Thakur, learned Advocate appearing for the petitioners has submitted that the death took place on 18.10.2017, but the F.I.R. has been lodged on 07.11.2017. Though the informant has tried to give an explanation regarding such late filing of the F.I.R., but that does not appear to be plausible. It has further been submitted by him that the husband of the deceased is in jail.

During the course of investigation, it has been submitted, one of the sisters of the informant made a statement that when she along with the informant went to the matrimonial home of the deceased, the deceased was found lying dead.

The deceased has a one year old son, who is staying with the petitioners.

The investigation reports further reveal that at one point of time, finding the accusation to have been lodged on some misconception, an effort was made from the side of the informant to have a settlement effected, but to no avail. Regard being had to the aforesaid facts, especially that a child of the deceased is staying with the petitioners and that the husband of the deceased is in custody, the petitioners, above named, in the event of their
