Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

At the outset, it is submitted on behalf of the petitioner that the petitioner had criminal antecedent of one case, in which he has already been acquitted by the trial court. The petitioner seeks bail in a case registered under Sections-341, 323, 307, 379, 120(B) of the Indian Penal Code and 27 of the Arms Act.

Prosecution case in short is that while the informant was going to Bhadas Brahmsthan Chowk by means of Erickshaw carrying two persons namely Arvind Sahni and

Patna High Court CR. MISC. No.50951 of 2022(2) dt.22-12-2022 2/2 Mantun Sharma, he was fired by accused persons which hit right hand of the informant.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-04-2022. Charge sheet has already been submitted in this case. The name of the petitioner has transpired in this case only on the basis of suspicion. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S.
