2. The petitioner is apprehending his arrest in connection with Samastipur Town P.S. Case No. 160 of 2022, dated 14.06.2022 for the offences punishable under Sections 341, 323, 324, 325, 326, 307, 384, 506/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused persons along with 30-40 miscreants are alleged to have come and fired 10 rounds indiscriminately which hit the informant's brother Md. Ashraf and Belal Ansari on his
Patna High Court CR. MISC. No.51194 of 2023(4) dt.20-02-2024 2/3 stomach.
4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. There is no overt act against the petitioner. There is no allegation of assault or firing against the petitioner as per the F.I.R. and the case diary there is general and omnibus allegation against the petitioner. The petitioner has nine criminal antecedents mentioned in Para 3 of the bail petition.
5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the allegation are being general and omnibus, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Samastipur in connection with Samastipur Town P.S. Case No. 160 of 2022 subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure, with further condition:- (i) The petitioner is directed to remain physically
