Petitioner, already in custody, seeks bail in connection with Lakhisarai P.S. Case No.38 of 2018 registered under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation in brief is that the petitioner called the informant's husband and they went for having dinner and the informant also followed her husband and after going to some distance she found that Ranjeet Bind, Sanjeet Bind and Awdhesh Bind shot at her husband causing his death thereafter escaped away.
Patna High Court Cr.Misc. No.31704 of 2018(5) dt.19-07-2018 2/2 Learned counsel for the petitioner submits that the informant is not the eye witness in the case. However, even as per her allegation, there is no specific overt act against this petitioner with regard to assault rather the specific allegation of killing the deceased is against Ranjeet Bind, Sanjeet Bind and Awadhesh Singh and one of the co-accused Ravi Bind was granted bail by a coordinate bench of this court by Cr. Misc No. 32276 of 2018.
Learned counsel appearing on behalf of the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances, petitioner Kunal Yadav @ Jitendra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Lakhisarai in connection with Lakhisarai P.S. Case No. 38 of 2018.
