The petitioner seeks bail in anticipation of his arrest in connection with K. Hat P.S. Case No. 198 of 2020, dated 11.04.2020, instituted for the offences under Sections 406, 419, 420, 188 and 120(B)/34 of the Indian Penal Code.

The petitioner is the proprietor of Araria Diagnostic, Purnia, who has been made accused along with

No.9902 of 2021(2) dt.20-12-2021 2/3 twenty two other pathological centers at the instance of the Civil Surgeon-Cum-Chief Medical Officer, Purnia for having set up the pathological Institutes without proper formalities. The pathological center of the petitioner and others were allegedly being run unauthorizedly.

It has been submitted on behalf of the petitioner that a notice in that regard was served upon him and no sooner did he receive such notice, he closed the pathological center. It has further been submitted that the petitioner was not made to know the irregularity for which such notice was issued to him.

Be that as it may, it has been argued that since the petitioner has already closed that institute, he deserves to be granted anticipatory bail. It has also been submitted that other proprietors of such pathological centers named in the F.I.R. have been granted anticipatory bail by the Court below only.

Considering the submissions afore-noted, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is

Patna High Court CR. MISC. No.9902 of 2021(2) dt.20-12-2021 3/3 directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No. 198 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
