2. The petitioner is apprehending arrest in connection with Salkhua P.S. Case No. 214 of 2024 lodged on 14.09.2024, for the offence punishable under Sections 126(2), 191(2), 191(3), 190, 352, 351(2), 118(1), 109 of B.N.S and Section 27 of Arms Act.

3. As per the prosecution, that on 13.09.2024, at about 8:00 PM, the informant was standing at his door, meanwhile informant's cousin brother alongwith his associates including the present petitioner arrived there and asked him to withdraw the application filed by him before the Circle Officer in respect to mutation of land. At the intigation of Ram Sundar, co-accused persons, started firing upon the informant, causing a firearm

Patna High Court CR. MISC. No.49201 of 2026(2) dt.22-07-2026 2/3 injury to his abdomen, as a result of which he became unconscious. Thereafter, his family members took him to the hospital for medical treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Counsel lastly submits that the petitioner has clean antecedent.

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. Having heard the parties, perused the order of learned lower court, Saharsa it transpires that there is no specific allegation against the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 214 of 2024, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023 and also subject to the following conditions: (I) One of the bailors shall be the petitioner's own or close member.

(III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
