Mr. Ashok Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Chausa P.S. Case No. 17 of 2018, registered for the offence punishable under Sections 354, 354-B and 34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein teasing the wife of the informant as well as the sister-in-law of the informant when they had gone to the market.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in

Patna High Court Cr.Misc. No.31672 of 2018(2) dt.31-05-2018 2/2 custody since 23.01.2018. It is further submitted that the similarly situated co-accused person has already been granted bail by this Court by an order dated 12.04.2018 passed in Criminal Miscellaneous No. 19892 of 2018.

Per contra, Mr. Ashok Kumar, the learned APP for the State has vehemently opposed the prayer for bail. Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 17 of 2018.
