Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 87, 351(2), 351(3), 352, 3(5) of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 21-12-2024 at about 8.30 pm when he came back home, he saw his wife and petitioner in a compromising position, thereafter an altercation took place and the wife of the informant along with the petitioner abused and tried to kill the informant, but in the occurrence the wife of the informant got injured, thereafter the informant called on 112, accordingly an ambulance came and his wife was taken to the hospital, but

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that wife of the informant has given an affidavit before the learned trial court, wherein she has stated that informant is a drunkard and comes home in a drunken condition and then used to assault her, further since petitioner and his family is her neighbor as such they used to save her from the assault of the informant, as such the present false case came to be instituted. It is thus submitted that wife of the informant has not supported the case of the prosecution. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nokha P.S. Case
