JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-12-2023 This writ application has been filed for issuance of direction to the Project Director, National Highway Authority of India, N.H-83 and District Land Acquisition Officer, Jehanabad
Patna High Court CWJC No.11709 of 2023(4) dt.11-12-2023 2/3 for proper evaluation and measurement of the land situated at Mauja- Meghariya, Thana No 347, Khata Number 131, Plot No 318, Area- 18.75 decimal (7.27 decimal compensation has been given and 11. 48 decimal of land out to have been left out in the land of the petitioners) but unfortunately on demarcation, only 3.43 decimal of land is left out., in second land - MaujaMeghariya, Thana No 347, Khata Number 131, Plot No 318, Area-3.7 decimal, 3 decimal compensation has been given .75 decimal out to have been present of the present petitioners but no land is left out and to give compensation of the said land; on the ground that the land of the present petitioners have been taken more than the notification issued under section 3-A and 3D with regard to acquiring of the land for project NH-83 on 30.10.2012.
2. However, after some argument, learned counsel for the petitioners requests for disposal of the present writ application with a direction to the District Magistrate, Jehanabad / Respondent No. 9 to dispose of the representation dated 26.07.2021 of the petitioners.
3. In view of limited prayer made on behalf of the petitioners, the writ application stands disposed of with a direction to the Respondent no. 9/District Magistrate, Jehanabad
Patna High Court CWJC No.11709 of 2023(4) dt.11-12-2023 3/3 to dispose of the representation dated 26.07.2021 of the petitioners (Annexure P/6 to the writ application), after hearing the parties, in accordance with law preferably within a period of six months from the date of receipt/production of the copy of this order.
4. With above direction, the writ application stands disposed of.
