====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.
2. The petitioner seeks regular bail in a case registered for the offence punishable under Sections 399, 402 and 120(b) of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per prosecution case, on the basis of secret information, a raid was conducted at Dhapri Middle School, where three accused persons fled away and two accused persons were apprehended on the spot with arms and ammunition, who disclosed the name of this petitioner.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R. and
Patna High Court CR. MISC. No.49951 of 2025(2) dt.12-09-2025 2/2 his name transpired only on the basis of the confessional statement of apprehended co-accused persons.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that the petitioner has got nine criminal antecedents, some of which are of a similar nature.
6. Considering the nature of accusation and the fact that the petitioner has got nine criminal antecedents, some of which are of a similar nature, the prayer for grant of bail to the petitioner is rejected.
