The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 234 litres of liquor is stated to have been recovered from the house of accused Kundan Kumar @ Golu. It is further stated that on enquiry, he disclosed the name of two Sonu. It was for business that the seized liquor has been bought.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. Although the alias name of the petitioner is also Sonu, however, he is not any of the two persons named

Patna High Court CR. MISC. No.60507 of 2021(2) dt.09-12-2021 2/2 by co-accused Kundan Kumar. The petitioner has no criminal antecedent and is in custody since 29.7.2021. A supplementary affidavit is filed on behalf of the petitioner. Let the same be kept on record. It is submitted by learned counsel for the petitioner that in the supplementary affidavit the invitation card with respect to marriage of the sister of the petitioner, which is scheduled on 13.12.2021, has been brought on record.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.3800 of 2021 (Danapur P.S. Case no.417 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
