The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363, 366A, 341, 323, 354A and 504 of the Indian Penal Code. The prosecution case got initiated on the basis of written report of Hira Devi submitted before the Station House Officer, Andharamath Police Station is to the effect that on 16.05.2018, the minor daughter of the informant Jiwachhi Kumari went to ease out when this petitioner along with three unknown kidnapped her. It is further alleged that when the informant went to the house of the petitioner to make complain, the family members of the petitioner abused and assaulted her.

No.48195 of 2019(24) dt.02-08-2019 2/2 It is submitted by learned counsel for the petitioner now the informant has retracted from the initial version and the victim got married with some other person. Considering the nature of accusation and the accusation being supported by the victim girl in her statement recorded under Section 164 Cr.P.C, to the effect that the petitioner kidnapped her, this Court is not inclined to enlarge the petitioner on bail.

However, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection Andharamath P.S. Case No. 65 of 2018, pending before the learned ACJM, Jhanjharpur, Madhubani.

With the above observation, this application is, accordingly, disposed of.
