JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Desari Police Station Case No. 32 of 2014 registered for the offences punishable under Sections 448, 341, 427, 323, 376, 511, 379, 504/ 34 of the Indian Penal Code.
There is accusation against the petitioner that he along with his father entered the house of the informant and father of the petition tried to remove the cloths of the informant. The contention on behalf of the petitioner is that there is series of litigation between the parties as the informant's husband and petitioner are agnates. It is further contended by him that much prior to institution of the present case, the father of the
Patna High Court Cr.Misc. No.34389 of 2014 (2) dt.16-02-2015 2/2 petitioner lodged complaint cases against the informant and her family members and proceeding under section 107 of the Cr.P.C was also pending between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Vaishali at Hajipur in Desari Police Station Case No. 32 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
