The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
The prosecution case is that the petitioner and others overtook the informant while he was travelling on a Maruti car. The firing made by co-accused Pramod Patel hit on the car whereas the firing made by the petitioner caused injury to the informant.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.11726 of 2016 (2) dt.14-12-2016 2/2 petitioner that there is a counter version of the occurrence also and for the occurrence of 04.06.2014 the FIR was registered on 11.06.2014. It is further submitted that the prayer for anticipatory bail has been renewed since the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
The aforesaid facts constitute ground for consideration of prayer for bail, if the petitioner surrenders before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order in connection with Bairiya P.S. Case No. 119 of 2014 pending in the court of learned Chief Judicial Magistrate, West Champaran at Bettiah.
Accordingly, this application is disposed of.
