Mr. Vinod Shankar Modi ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-05-2018 Heard learned counsels for the petitioner and the State. The petitioner apprehends his arrest in connection with Banka (Barahat P. S. Case No. 457 of 2017 instituted under Sections 307, 341, 504 and 506/34 of the Indian Penal Code and Sectons 3 and 4 of the Explosive Substance Act. It is contended that there is land dispute between both sides regarding raises of the land and the petitioner used to protest encroaching upon the land of him, so has been falsely implicated and there is no injury to anyone and no material of bomb was found except Sutali on the so-called place of occurrence and the seizure was made on 04.08.2017 at 12:30 O'clock though according to FIR, information was received on 15:45 O'clock on the same day and the petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.31803 of 2018(2) dt.21-05-2018 2/2 let the petitioner, namely, Kanhaiya Darbey @ Kanahay Darve, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S.Case No. 457 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
