2. The petitioner seeks bail in connection with Karakat P.S. Case No. 42/2023 registered for the offence punishable under Sections 341/323/504/506/307/302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is in jail since 23.09.2023.

3. As per the prosecution case, the petitioner and one Niraj Singh are the assailants of the deceased.

4. It has been submitted by the learned counsel for the petitioner that though the petitioner is in custody and charges have been framed but not a single witness has been examined after framing of charge.

5. Considering the fact that the petitioner is the assailant of the deceased, this application is dismissed.

6. The trial Court is directed to expedite the trial.

7. The Superintendent of Police, Rohtas is directed to see to it that the witnesses are produced regularly in the sessions trial. Any delay in the trial will result in action against the prosecution including the district administration.

8. Let a copy of the order be communicated to the Superintendent of Police, Rohtas through FAX/e-mail forthwith for compliance of the order.

9. Mr. Jharkhandi Upadhyay, Additional Public Prosecutor will assist this Court.
