The petitioner apprehends his arrest in Hajipur Sadar P.S. Case no. 352 of 2014, registered for the offences punishable under Sections 376/511 of the Indian Penal Code. The victim made allegation against the petitioner that he made attempt to outrage her modesty. The victim disclosed this fact before the villagers and the villagers tried to pacify the matter. It is submitted that there was land dispute between the father of the petitioner and the father of the victim. Having considered the fact that the victim is aged about 13 years and she has made allegation against her teacher who tried to outrage her modesty, I am not inclined to enlarge the

Patna High Court Cr.Misc. No.43701 of 2014 (3) dt.14-05-2015 2/2 petitioner above named on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
