Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that on 21.10.2015 at 8.30 P.M. all of a sudden the petitioner, co-accused Dani Singh, Bijay Singh, Lav Kumar, Kush Kumar and Mandal Kumar came to the house of the informant and started pelting stones. It is alleged against the petitioner that he resorted to fire in the air. The motive for the occurrence has been alleged to be the assault made by the petitioner to one Ratan Singh. It is submitted by the learned counsel for the petitioner that accusation of causing injury by pelting stones is

Patna High Court Cr.Misc. No.10216 of 2016 (2) dt.03-03-2016 against co-accused Lav Singh and Kush Singh. The injury has been found to be simple in nature. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kauakol (Rupau) P.S. Case No. 121 of 2015, pending in the court of learned A.C.J.M.-IV, Nawada.

With this observation this application is disposed of.
