The petitioner, already in custody, seeks bail in connection with Dhangai P.S.Case No. 69 of 2017 registered under Sections 302/34 of the Indian penal Code and under Section 27 of Arms Act.
Earlier the prayer of bail of the petitioner was rejected. Allegation against this petitioner is that he along with one Umesh Sharma and Jainath Paswan caught hold the informant's son and it is alleged that Raj Nath Paswan, Nami Paswan and Janardan Mahto shot at the deceased.
Learned counsel for the petitioner submits that Janardan Mahto and Nami Paswan were granted bail by coordinate Benches of this Court vide Cr. Misc. No. 8485 of 2018 and Cr. Misc. No. 21737 of 2018 and considering that aspect Umesh Sharma was also granted by this Court vide Cr. Misc. No. 7699
Patna High Court Cr.Misc. No.34981 of 2018(3) dt.18-07-2018 2/2 of 2018 and similar is the accusation against this petitioner. Having considered the aforesaid facts and circumstances, the petitioner, namely , Shahanand Kahar @ Sahanand Prasad is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions and District Judge-VI, Bhojpur at Ara in connection with S.Tr. No. 60/2018 arising out of Dhangai P.S. Case No. 69 of 2017. (Arun Kumar, J) sujit/- U T
